Terms of use.

By installing or using Nivela AutoDimension (the "Software") you agree to these terms. If you do not agree, do not install or use the Software.

1. Licence

Nivela grants you a personal, non-exclusive, non-transferable and revocable licence to use the Software while your subscription is active. The licence covers up to 2 (two) devices per subscription. The Software is licensed, not sold.

2. Subscription, billing and cancellation

The Software is distributed as a recurring monthly subscription, processed by Stripe. After the free trial period, where applicable, you are charged automatically each cycle until you cancel.

When you subscribe, Stripe runs a card validity check for a zero or nominal amount. It is not a charge and it is reversed automatically, but it may trigger an alert from your bank. If you cancel during the free trial, no charge is made.

You can cancel at any time through the subscription management portal in my account. Access stays active until the end of the period already paid for. Partial periods are not refunded, except as described in the refund policy.

You have 7 (seven) calendar days from the first charge to change your mind and receive a full refund. The full conditions are in the refund policy.

3. What you may not do

4. Ownership

The Software, including its code, brand and associated materials, belongs to Nivela. No rights beyond the licence described here are granted to you.

5. Changes to your project

The Software creates and, depending on the settings you choose, replaces dimensions inside your Revit project. Although changes can be undone with Ctrl+Z within the same session, you are responsible for keeping backups of your work before using the Software, particularly before using it for the first time on a real project.

6. Known limitations

The Software relies on Revit API behaviour that Autodesk does not fully document, and that was verified only on the Revit version stated inside the application itself. Using it on other versions, or using features marked as experimental in the interface, may produce incorrect results with no visible warning.

7. Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

8. Limitation of liability

To the maximum extent permitted by law, Nivela will not be liable for indirect, incidental, special or consequential damages arising from the use of or inability to use the Software, including loss of data or project rework. Nivela's total liability, in any circumstance, is limited to the amount you paid over the last 3 (three) months of subscription.

9. Data

To operate licensing, the Software sends Nivela's server a device identifier generated locally and your licence key. Payment is processed directly by Stripe; Nivela does not store card data. Details in the privacy policy.

10. Termination

This licence ends automatically if you stop paying the subscription, if you breach these terms, or at your request through cancellation. After it ends, you must stop using the Software.

11. Changes to these terms

These terms may be updated. Continuing to use the Software after an update constitutes acceptance of the new terms.

12. Governing law

Nivela is established in Brazil, and these terms are governed by Brazilian law. Nothing here removes any right you have under the mandatory consumer law of the country where you live.
